Agreement to Terms

These Terms & Conditions (“Terms”) govern your access to and use of the App, our websites, and related services (collectively, the “Services”). Please read the Terms & Conditions carefully before you start to use the App. By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy (the “Privacy Policy”). If you do not agree, do not use the Services. As described in the Privacy Policy, your catch and trip logs are private to you unless you choose to share.

Who May Use the Services

You may use the Services only in compliance with applicable laws, rules, and regulations. You must provide accurate information and keep it up to date. You are responsible for safeguarding your credentials and for all activities under your account.

You must be at least 16 years old to use the Services. By using the Services, you represent and warrant that you are of legal age to form a binding contract with the Company or that you have received the permission of your parent or guardian to access the Services, and that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Services.

App Overview & Tiers

CatchIQ is a fishing log and trip-planning app for anglers. We currently offer:

• Free Tier: Supported by advertising.
• Paid Tier: No ads + analytics features.
• Premium Tier: Includes planning and forecasting features.

Features may vary by region, device, or app version and may change from time to time.

Closed Beta; Pre-Release Features

From time to time, we may offer closed beta or pre-release features. These may be incomplete, change without notice, or be withdrawn at any time. You agree not to disclose non-public pre-release information you learn through the beta (e.g., screenshots, performance details) without our written permission. We may collect additional diagnostics as described in the Privacy Policy to improve stability and performance.

Subscriptions, Trials, and Payments

Purchases and subscription management are handled by Apple App Store and/or Google Play via RevenueCat. We receive subscription status and purchase metadata but do not receive full payment card numbers. See the Privacy Policy for details.

• Billing & Renewal. Subscriptions automatically renew each billing period unless canceled via your app store account before the renewal date.
• Trials & Promotions. If available, trials convert to paid subscriptions unless canceled in time. Eligibility and duration are shown in-app or in the app store.
• Refunds. Refunds, chargebacks, and cancellations are handled under the app store's policies. Please see Apple/Google support pages to request refunds.
• Price Changes. We may change prices or introduce new charges with notice as required by the applicable app store; changes typically apply at the next renewal.

Ads and Marketing (Free Tier)

The Free Tier shows ads that may use device advertising identifiers and contextual information to deliver and measure ads. You can limit ad tracking in your device settings where available. Paid and Premium tiers do not show third-party ads. See the Privacy Policy for details and opt-out options.

User Content; Privacy Controls

“User Content” includes photos, notes, catch details (species, size/weight), trip logs (date/time, location notes), waypoints, tags, comments, and any other material you upload or create in the Services. User Content is private unless you change your settings to share (e.g., with friends, groups, or publicly).

Your License to Us. To operate and improve the Services, you grant CIQ a worldwide, non-exclusive, royalty-free license to host, process, display, reproduce, modify, and create derivative works from your User Content solely to (i) provide the Services and features you select (including analytics and forecasting), (ii) maintain backups and security, and (iii) develop and improve the Services (e.g., aggregate/anonymized model training). You represent you own or have the rights to upload the User Content and that it does not violate law or third-party rights.

Photos may include embedded metadata (e.g., date/location). If you share a photo, recipients may see such metadata. You can remove metadata before uploading or disable location tagging in your camera settings.

If you submit feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.

Acceptable Use

You agree not to:

1. Use the Services for any unlawful purpose, including violating fishing regulations or trespass laws;
2. Upload content that is illegal, infringes IP or privacy rights, or is harassing, hateful, or obscene;
3. Attempt to reverse engineer, decompile, or otherwise access source code except as permitted by law;
4. Interfere with or disrupt the Services or related networks;
5. Circumvent access or content protections, or misuse reporting/flagging systems;
6. Misrepresent your identity or affiliation;
7. Use the Services to build a competing product or to scrape or harvest data at scale.

We may suspend or terminate access for violations (see Suspension and Termination below).

Forecasting, Analytics, and Planning Tools

Our analytics and forecasting features (especially in the Premium Tier) analyze your logs, preferences, and—where enabled—location and environmental inputs to generate insights. Some forecasting and analytical outputs are generated using machine learning and other forms of artificial intelligence (“AI”), which rely on statistical models, historical patterns, and probabilistic estimation. These tools are intended to provide general informational insights only. AI-generated outputs may be incomplete, inaccurate, or reflect model limitations, and forecasts are estimates only that can be affected by many factors outside our control (e.g., weather variability, water conditions, regulation changes). We do not guarantee outcomes (including catch success), and you remain responsible for your fishing decisions and compliance with local laws.

Third-Party Services & Links

The Services integrate with or link to third parties, including Firebase (hosting/auth/crash/analytics), RevenueCat (subscriptions), app stores, and ad networks (Free Tier). Third-party terms and privacy policies govern their services. We are not responsible for third-party content, products, or services.

Intellectual Property; License to Use the App

The Services, including the App, software, design, logos, and content (excluding User Content), are owned by CIQ or our licensors and protected by intellectual property laws. Subject to these Terms, CIQ grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial angling activities. You may not copy, modify, distribute, sell, sublicense, or create derivative works from the Services except as expressly permitted.

Data; Privacy; Security

Your use of the Services is also governed by our Privacy Policy, which explains what we collect, how we use it, and your rights and choices, including region-specific disclosures (e.g., California). We employ administrative, technical, and physical safeguards designed to protect your information; however, no security measures are perfect.

Contractors and Service Providers

We may engage contractors and service providers (e.g., for development, support, analytics, hosting) who will access personal information only to provide services to us and are bound by confidentiality and data-processing obligations consistent with our Privacy Policy.

No Tournaments or Sponsor Partnerships

At launch, we do not host tournaments or offer sponsor partnerships. If we introduce such features later, we will update these Terms or provide supplemental terms.

Outdoor Activity and Safety Disclaimers

Fishing and related outdoor activities involve inherent risks, including but not limited to changing weather conditions, water hazards, wildlife encounters, equipment failures, slips, falls, navigation errors, and other environmental or situational dangers. You acknowledge and agree that you participate in all outdoor activities at your own risk and that CIQ, LLC is not responsible for your safety, decisions, or conduct while outdoors.

The App may provide planning tools, environmental information, AI-generated forecasts, maps, or other insights intended to support your personal decision-making. These features are informational only and are not guarantees of safety, environmental conditions, or fishing outcomes. Environmental variables can change rapidly, and the App may rely on third-party data sources, user inputs, or predictive models that may be incomplete, inaccurate, delayed, or unavailable.

You are solely responsible for:

• Assessing weather, water conditions, terrain, and other hazards before and during any outing;
• Using appropriate safety equipment and exercising reasonable judgment;
• Complying with all applicable laws, regulations, and safety guidelines;
• Ensuring that any location you visit is safe, legal, and accessible;
• Maintaining awareness of your surroundings and acting in accordance with your own skill level and physical condition.

CIQ does not provide professional safety, navigation, rescue, or emergency guidance. The App is not a substitute for real-world safety precautions, official weather advisories, or local authority instructions. Always follow governmental warnings, posted signs, and the directions of relevant authorities.

To the fullest extent permitted by law, CIQ is not liable for any injury, loss, damage, or harm arising from your participation in outdoor activities, reliance on App outputs, or failure to take appropriate safety measures.

Ownership of Aggregated and De-Identified Data

CIQ, LLC owns all aggregated and de-identified data derived from the Services and User Content. To the extent permitted by law, such data is the exclusive property of CIQ and does not constitute User Content. CIQ may use this aggregated and/or de-identified data for any lawful purpose, including analytics, benchmarking, forecasting improvement, research, and product or service development, provided that the data does not identify you or any individual.

Changes to the Services

We may modify, suspend, or discontinue all or part of the Services (including specific features, tiers, or pricing) at any time, with notice as required by law or the applicable app store.

Suspension and Termination

We may suspend or terminate your access if you violate these Terms, abuse the Services, or create risk or legal exposure for us or others. You may stop using the Services and/or delete your account at any time (see the Privacy Policy for data deletion). Sections that by their nature should survive termination will survive (e.g., IP, disclaimers, liability limits, arbitration).

Disclaimers

You understand that we cannot and do not guarantee or warrant that files available for downloading from the internet or the App will be free of viruses or other destructive code. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for anti-virus protection and accuracy of data input and output, and for maintaining a means external to our site for any reconstruction of any lost data. TO THE FULLEST EXTENT PROVIDED BY LAW, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY A DISTRIBUTED DENIAL-OF-SERVICE ATTACK, VIRUSES, OR OTHER TECHNOLOGICALLY HARMFUL MATERIAL THAT MAY INFECT YOUR MOBILE DEVICE, COMPUTER EQUIPMENT, COMPUTER PROGRAMS, DATA, OR OTHER PROPRIETARY MATERIAL DUE TO YOUR USE OF THE APP OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP OR YOUR DOWNLOADING OF ANY MATERIAL POSTED ON IT, OR ON ANY APP LINKED TO IT.

YOUR USE OF THE APP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP IS AT YOUR OWN RISK. THE APP, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER THE COMPANY NOR ANY PERSON ASSOCIATED WITH THE COMPANY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE APP. WITHOUT LIMITING THE FOREGOING, NEITHER THE COMPANY NOR ANYONE ASSOCIATED WITH THE COMPANY REPRESENTS OR WARRANTS THAT THE APP, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE APP OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE APP WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIQ AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CIQ FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) $100. Some jurisdictions do not allow certain limitations; in such cases, these limits apply to the fullest extent permitted.

Indemnification

You agree to indemnify, defend, and hold harmless CIQ and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your infringement or misappropriation of any third-party rights.

Export Controls and Sanctions

You may not use or access the Services if you are located in, under the control of, or a national or resident of any country subject to U.S. embargo or sanctions, or if you are on any U.S. government restricted lists. You agree to comply with all applicable export control and sanctions laws.

Mobile App Store Terms

Apple. If you download the App from the Apple App Store, you acknowledge that these Terms are between you and CIQ only, not Apple; CIQ is solely responsible for the App; Apple has no obligation to provide maintenance or support; and Apple and its subsidiaries are third-party beneficiaries who may enforce these Terms against you.

Google. If you download from Google Play, you agree to comply with Google Play's terms and policies in addition to these Terms.

Governing Law; Dispute Resolution

All matters relating to the Services and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the Commonwealth of Pennsylvania without giving effect to any choice or conflict of law provision or rule (whether of the Commonwealth of Pennsylvania or any other jurisdiction).

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the Commonwealth of Pennsylvania, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

YOU AND CIQ, LLC EACH KNOWINGLY AND IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY in any action, proceeding, or counterclaim arising out of or relating to these Terms or your use of the App.

Nothing in this Section prohibits CIQ from seeking injunctive or equitable relief in any jurisdiction where such relief is available or necessary.

Notices; Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notice, email (where required), or by updating the “Effective Date.” Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Services and delete your account.

Waiver and Severability

No waiver by CIQ of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and CIQ regarding the App and the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App and the Services.
